California Privacy Notice

  1. Background and scope

This Privacy Notice (“Notice”) describes how Dizzytogo.com (account.dizzyandvertigo.com) (“Dizzy & Vertigo”) protects the privacy of personal information for consumers residing in California under the California Consumer Protection Act (“CCPA”).

This Privacy Policy does not apply to protected health information that we collect from individuals pursuant to the Health Insurance Portability and Accountability Act (HIPAA).

Dizzy & Vertigo specializes in the assessment, treatment and management of dizziness – related symptoms.  Dizzy & Vertigo collects, uses, and discloses personal information on our mission of providing care for dizziness – related conditions. We are committed to protecting the privacy and confidentiality of personal information and to maintaining various physical, electronic and procedural safeguards to protect personal information in our care.

  1. What Personal Information do we Collect?

Personal information refers to data that could be used, alone or in combination with other data, to identify you as an individual. Personal Information also includes information designated as such under California law. Personal Information does not include publicly available information, or information that is deidentified or aggregated information.

Dizzy & Vertigo collects the following categories of personal information:

  • Identifiers:
    • contact information (such as name, postal address, telephone number, email address);
  • Personal information described in Cal. Civ. Code § 1798.80(e), but not otherwise described including signature, credit card number, and medical information; and
  • Internet or other electronic network activity (such as access logs).

The above information may be collected about the user who creates an account or accesses their Dizzy & Vertigo account.  Consistent with the Terms of Use, users under the age of 18, must have parental consent prior to creating a user account.  For children under the age of 13, a parent or legal guardian must create the user account  on behalf of the child and supervise the child’s use of the Dizzy & Vertigo applications at all times.

  1. How do we collect personal information?

Dizzy & Vertigo collects personal information from the following categories of sources:

  • You, we collect personal information directly from our interactions with you, for example:
    • When you book an appointment, either online or by telephone. When you provide information by telephone or in person.
  • Referring physicians or other third parties involved in your treatment plan, as authorized by you; and
  • Service providers/contractors/third parties that manage, maintain, and protect our facilities and services, for example:
    • Network security providers for our on-premise IT environment
    • Payment processors

 

  1. Why do we collect your personal information?

Dizzy & Vertigo collects Personal Information for the following purposes:

  • providing you with access to our services, including providing video content to you, providing you with access to our content, creating and maintaining an account with us, and processing your payments;
  • managing, maintaining, and protecting our digital environment, such as our network environment, our websites, and our applications, including detecting, deterring, protecting against, and investigating fraudulent, unauthorised, unlawful, or illegal activities;
  • complying with and enforcing our legal requirements, including regulatory reporting and compliance, requests from law enforcement, requests of governmental authorities, and valid court orders or from other valid legal process; and
  • performing business functions necessary to support and maintain the business of Dizzy & Vertigo, including internal accounting and administration.
  1. Is personal information sold or shared with third parties?

In the preceding 12 months we have not “sold” (as the term “sale” is defined in the CCPA) and/or “shared” (as the term “share” is defined in the CCPA) any personal information.

To our actual knowledge we do not sell or share the personal information consumers under 16 years of age.

  1. Is personal information disclosed?

Dizzy & Vertigo may have disclosed your Personal Information to the persons or entities described in this Section. We do not disclose your Personal Information to other parties, except as described in this Notice. The parties to whom we disclose Personal Information in this Section are required to maintain the confidentiality of such Personal Information and are prohibited from using your Personal Information for purposes other than those agreed. As used in this section, “disclose” means transfer, send, or otherwise make available or accessible to another person or entity, but does not include selling or sharing as those terms are defined under the CCPA.

Your Personal Information may be disclosed to the following categories of parties:

  • Service providers, contractors, and suppliers who perform services to facilitate the business of Dizzy & Vertigo, such as accountants, auditors, attorneys, tax advisors, insurance brokers, entities assessing our compliance with industry standards, investigation providers, payment processing providers, security vendors, information technology vendors, and other similar services (“Service Providers”);
  • Transactional parties, in the event of any contemplated or actual re-organization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stocks (“Transactional Parties”);
  • Government agencies, law enforcement authorities, or judicial bodies (“Governmental Authorities”);

We do not use or disclose your sensitive personal information for purposes other than those allowed under the CCPA, including Section 7027, subsection (m).

Dizzy & Vertigo maintains appropriate safeguards in place to protect the security, confidentiality, and integrity of your personal information.  Safeguards may include administrative, physical, and electronic safeguards to protect against the unauthorized access, disclosure, alteration, destruction, loss, or misuse of your personal information.
